ADU Builder in Newport Beach, CA
Newport Beach property owners pulled permits for 57 ADUs in 2025, up from 43 in 2023, according to the City’s housing reports to the state. Whether it’s a garden studio for family, a unit over the garage or a converted garage, the rules here mix state ADU law with the City’s coastal program, and the order you tackle them in matters.
Building an ADU on a Newport Beach lot
Orange Home Builders is a design-build general contractor based in Newport Beach (CSLB #1117595, class B). Our design team prepares 3D designs and construction drawings, we handle the permits and HOA paperwork, and a project manager runs construction.
ADU types the City allows
The City’s ADU Ordinance Summary describes four main options, plus junior units:
- JADU: up to 500 sq ft, created inside an existing single-unit home.
- Internal ADU: converted floor area inside the existing house, including the garage.
- Attached ADU: a new addition joined to the house.
- Detached ADU: a new freestanding unit in the yard or over a garage.
Our ADU and additions service covers how we design and build each type.
Newport Beach ADU standards at a glance
These figures come from the City’s ADU Ordinance Summary (Municipal Code Sections 20.48.200 and 21.48.200). We confirm them with Planning for every project, because the summary itself notes that state law has moved ahead of parts of the adopted code.
- Size: attached and detached ADUs up to 850 sq ft for a studio or one bedroom, and 1,000 sq ft for two bedrooms. An attached ADU can’t exceed 50% of the existing home. Floor area and lot coverage limits can’t shrink a unit below 800 sq ft.
- Height: 16 feet for a detached ADU, with limited exceptions listed in the summary.
- Setbacks: 4 feet from side and rear lot lines (the rear figure applies when the lot doesn’t abut an alley), or the base zone if less. Converting existing floor area, a garage or a carport needs no additional setback.
- Design: the ADU must have a similar style to the main house, including architectural style, roof pitch, color and materials.
- Kitchen and bath: a full kitchen with a fixed cooking appliance vented outside, and a bathroom.
Zoning clearance and the coastal zone
Newport Beach reviews every ADU and JADU ministerially, through a Zoning Clearance issued within 60 days of a complete application. Properties in the Coastal Zone may also need a Coastal Development Permit, and the City asks owners to consult a planner before submitting. State law, summarized in HCD’s ADU Handbook, requires a CDP for an ADU to be approved or denied within 60 days of a complete application.
What this means in practice: a coastal lot isn’t a deal-breaker, but the CDP has to be planned alongside the ADU design, not after it. The City’s summary also notes that additional setbacks may be required for coastal resource protection, and that additional deed restrictions apply in the Coastal Zone.
Parking, garages and conversions
The City summary requires one parking space for an attached or detached ADU, but waives it when the property is:
- within one-half mile walking distance of transit, including ferry service
- in an architecturally or historically significant district
- in an area where on-street parking permits are required but not offered to the ADU occupant
- within one block of a car-share pick-up and drop-off location
Converting a garage is allowed. Citywide, replacement parking is required for a garage converted into a JADU. For a garage converted into an ADU, replacement parking is required in the Coastal Zone.
Deed restriction, rentals and sale
Before the building permit is issued, the owner records a City-prepared deed restriction describing the unit, banning short-term rentals and prohibiting sale of the ADU or JADU separately from the main house. Short-term lodging is prohibited. (Owner-occupancy is a separate question. HCD’s 2026 handbook says state law no longer allows owner-occupancy requirements for ADUs, while JADUs that share sanitation with the main house still require it. The City’s 2022 summary predates that change, so we confirm current wording with Planning.)
Costs the state limits
HCD’s handbook says an ADU of 750 sq ft of interior livable space or less is exempt from impact fees charged by local agencies, special districts and water corporations. School districts can’t charge impact fees on ADUs under 500 sq ft. Fire sprinklers are required in an ADU only if they’re required for the main home. We size the unit with these limits in mind.

Newport Beach ADU FAQ
How big can an ADU be in Newport Beach?
Per the City’s ADU summary, attached and detached ADUs can be up to 850 square feet for a studio or one bedroom and 1,000 square feet for two bedrooms. An attached ADU is also capped at 50% of the existing home, and a JADU at 500 square feet.
Does my Newport Beach ADU need a Coastal Development Permit?
It may if the property is in the Coastal Zone. The City recommends consulting a planner before you submit, and state law requires the CDP to be approved or denied within 60 days of a complete application.
Do I need to add a parking space for my ADU?
Attached and detached ADUs normally need one space, but the City waives it within a half-mile walk of transit, including ferry service, in historic districts, where on-street permits aren’t offered to the occupant, or within one block of car-share.
Can I convert my garage into an ADU?
Yes. Garage conversions are allowed. Replacement parking is required when a garage becomes a JADU anywhere in the city, and when it becomes an ADU in the Coastal Zone.
Can I rent out or sell my Newport Beach ADU?
You can rent it, but short-term lodging is prohibited, and the recorded deed restriction bars selling the ADU separately from the main house.
Will I pay impact fees on an ADU?
Under state law, as summarized in HCD’s ADU Handbook, an ADU with 750 square feet or less of interior livable space is exempt from impact fees, and school districts can’t charge impact fees on ADUs under 500 square feet.
