TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern your access to and use of the website located at https://oh.builders (the “Site”), operated by Orange Home Builders (“Company,” “we,” “us,” or “our”), a licensed general contractor in the State of California (CSLB License #1117595). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

  1. ABOUT THESE TERMS

These Terms apply to your use of the Site only. They do not constitute, and are not a substitute for, a construction contract, proposal, or work agreement. Any actual remodeling, construction, ADU, or related services performed by the Company will be governed exclusively by a separate written contract signed by both parties (“Project Contract”). In the event of a conflict between these Terms and a Project Contract, the Project Contract controls.

  1. USE OF THE SITE

You agree to use the Site only for lawful purposes. You may not:

We reserve the right to restrict or terminate your access to the Site at any time, without notice, for conduct we believe violates these Terms or is otherwise harmful to us, other users, or third parties.

  1. QUOTES, ESTIMATES & CONSULTATION REQUESTS

Any pricing information, estimates, project galleries, or descriptions of services displayed on the Site are provided for general informational purposes only and do not constitute a binding offer, quote, or guarantee of price, availability, timeline, or scope of work. Actual project pricing, scope, materials, and timelines will be determined only through a formal, written Project Contract following an in-person or virtual consultation and site evaluation.

Submitting a form on the Site does not create a contractual relationship between you and the Company. We reserve the right to accept or decline any project inquiry at our sole discretion.

  1. PAYMENT TERMS (PROJECT WORK)

Where applicable, payment terms for construction, remodeling, or ADU services — including deposit amounts, progress payment schedules, and final payment — will be set forth exclusively in the applicable Project Contract, in accordance with California law governing home improvement contracts (including but not limited to California Business & Professions Code provisions applicable to licensed contractors). Nothing on this Site should be relied upon as a statement of final project cost or payment schedule.

  1. INTELLECTUAL PROPERTY

All content on the Site — including text, graphics, logos, photographs of completed projects, videos, and design elements — is owned by or licensed to the Company and is protected by U.S. copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, publicly display, or create derivative works from any Site content without our prior written permission, except for personal, non-commercial viewing.

Project photographs displayed on the Site may depict work completed for past clients. Client names and identifying details are used only with consent or are omitted/anonymized where required.

  1. USER SUBMISSIONS

Any information, photos, or messages you submit to us through Site forms, email, or otherwise (“Submissions”) are provided voluntarily. By submitting content, you represent that you have the right to share it and grant the Company a non-exclusive, royalty-free license to use such Submissions for the purpose of responding to your inquiry and, where applicable and with your consent, for marketing purposes. Do not submit confidential or proprietary information you are not willing to share with us.

  1. THIRD-PARTY LINKS AND CONTENT

The Site may contain links to third-party websites, including review platforms (e.g., Yelp, Houzz, HomeAdvisor) and social media. We do not control and are not responsible for the content, accuracy, or practices of any third-party site. Links are provided for convenience only and do not imply endorsement.

  1. DISCLAIMER OF WARRANTIES

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF CONTENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Nothing in this Section limits or waives any warranty expressly provided under a signed Project Contract or required by California law for licensed contractor work.

  1. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY, ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR RELIANCE ON ANY INFORMATION DISPLAYED ON THE SITE (INCLUDING ESTIMATES, TIMELINES, OR PROJECT EXAMPLES).

OUR TOTAL AGGREGATE LIABILITY ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100). THIS LIMITATION DOES NOT APPLY TO LIABILITY ARISING UNDER A SEPARATELY EXECUTED PROJECT CONTRACT, WHICH IS GOVERNED BY ITS OWN TERMS AND APPLICABLE CALIFORNIA LAW.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

  1. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Company and its owners, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site, violation of these Terms, or violation of any rights of a third party.

  1. LICENSING DISCLOSURE

Orange Home Builders is a licensed general contractor in the State of California, CSLB License #1117595. License status can be independently verified at www.cslb.ca.gov. Nothing on this Site should be construed as legal, engineering, architectural, or professional advice; project-specific requirements (including permitting) will be addressed in your Project Contract.

  1. GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising from your use of the Site that is not otherwise governed by a Project Contract shall be subject to the exclusive jurisdiction of the state and federal courts located in Orange County, California, and you consent to personal jurisdiction and venue in those courts.

Disputes arising from a completed or in-progress construction project are governed exclusively by the dispute resolution provisions of the applicable Project Contract.

  1. CHANGES TO THESE TERMS

We may revise these Terms at any time by updating this page. The “Effective Date” above reflects the date of the most recent revision. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

  1. SEVERABILITY

If any provision of these Terms is found unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
